Noise, boundaries, the tree that blocks the light: neighbour conflicts weigh on you every day, because you cannot avoid each other. In mediation you work out an arrangement together that both sides can live with.

Why mediation instead of a lawyer’s letter
After a court case you usually still live next door. In mediation you shape the solution yourselves instead of having one imposed from outside.
I am impartial and bound to confidentiality. Both sides get room to speak, and I make sure the conversation stays fair.
§ 364 Abs 3 ABGB
Trees and plants: an attempt to agree before suing
Before bringing a claim under § 364 (3) ABGB concerning trees or plants that take light or air, Article III ZivRÄG 2004 provides for a conciliation body, a judicial settlement attempt or mediation.
Mediation with a registered mediator under the Austrian Civil Mediation Act (ZivMediatG) is one option if the owner of the trees or plants agrees. The statutory three-month period and evidence requirements also need attention; a first call alone does not fulfil these steps.

Does my neighbour have to agree?
Yes. Mediation is voluntary, so both sides need to take part. In the first call we can think through how to approach your neighbour.
Can we do it online?
Yes, by video. In-person sessions are possible in Vienna, evenings too.
Is the mediation confidential?
Yes. As a registered mediator I am bound to confidentiality under the Austrian Civil Mediation Act (ZivMediatG).
